“Golden Horizon” continues sailing – free of any liabilities

“GOLDEN HORIZON” CONTINUES SAILING – FREE OF ANY LIABILITIES"

Firstly, it is important to note that the objectivity of the media that published the news is best illustrated by the fact that it is now clear to even the most uninformed objective observer that the media has openly sided with our former business partner since March 2021. Their goal was to bring us to our knees. One such attempt is today's preposterous text, surpassed only by the even more preposterous fact that it was published on the cover. The text intends to charge Brodosplit of the non-existent obligations. Our former partner used all available (even free funds) means to put us in a situation where we were forced to deliver the ship to them – but on their terms. They failed, and the arbitration declined their request. To add to the absurdity, through the same media that made itself available to our former business partner, they tried to give the public the impression that they had won the arbitration - the one that rejected their request to have the vessel delivered to them.

And the fact that the journalist got the information on arresting the vessel before us speaks for itself, and we leave it to the public to draw their conclusions. We joked yesterday that the journalist was obviously in the same WhatsApp group with the Star Clippers team.

The message sent to us through the mentioned media by their representatives advising us to settle the debt after which the ship will be released immediately is hypocritical and unprofessional.

Those who stated that Brodosplit has refused to voluntarily meet the financial obligations, as well as those who published this statement, are aware it is a notorious lie. Brodosplit has never disputed any financial obligations. Moreover, in July 2019, the company first offered to pay “buyers supply” to Star Clippers for the delivered sailboats and masts. However, Star Clippers has rejected that even several times after the initial offer. This has all been documented (find attached).

They blackmailed us and demanded significantly more than the amount of the value of the delivered equipment, significantly more than the amount of the mortgage, but also significantly more than the arbitration determined that the delivery was worth.

The only reason for doing that was so as not to take out the mortgage after the payment - so that they could do what they did several days ago - to arrest the ship. This act was completely unfounded and evil, one could even say pirate.

However, regardless of the difficulties, it is important that as of today, the “Golden Horizon”, the largest and most luxurious cross-sailing clipper in the world, after more than two years of blackmail and pressure from a former client, no longer has a mortgage- and can operate all the seas of the world.

At the beginning of July, the owner of the “Golden Horizon” offered Star Clippers the payment of their claim against Brodosplit, which was secured by a mortgage on that vessel, under the conditions prescribed by the Croatian law - that Star Clippers allow the mortgage on the ship to be canceled in exchange for the payment. Brodosplit offered the payment to Star Clippers on several occasions, starting in 2019, but it was refused every time.

On July 8th 2021 the owner of the “Golden Horizon” sought the establishment of a court deposit account for a claim secured by a mortgage on the vessel in favor of Star Clippers, as Star Clippers refused to cancel the mortgage in exchange for the payment. The court allowed the court deposit account on July 14th. The payment on the court deposit account was just being prepared, when Star Clippers, with the apparent intention of harming the owner of the “Golden Horizon” and Brodosplit, arrested the ship in England. This arrest was completely unnecessary and was done in bad faith because the payment was offered voluntarily, as evidenced by the opening of a court deposit account.

This was just a continuation (luckily the last episode) of Star Clippers’pressure on Brodosplit and attempts to spread a negative marketing image of the “Golden Horizon”. It is important to note that in the previous dispute with Brodosplit, Star Clippers blocked the operation of the ship for almost 2 years and the owner of the “Golden Horizon”, initiated lawsuits for damages. Following that, the court in the Netherlands ruled to block the Star Clippers’ account for 23 million EUR. The owner of the vessel issuing Star Clippers for damages in the Bahamas. Proceedings have also been initiated to prosecute those responsible in Star Clippers for fraud and contempt of court decisions in France.
